Non-O Dependent Visa Thailand FAQ

Frequently asked questions about "Family Dependent Visa (Non-O)" — a guide for people working in Thailand

It is a visa for the immediate family of a foreign national who is working or doing business legally in Thailand. Eligible applicants are the spouse (with a legally registered marriage) and children (who must be legal children aged not over 20).

No. Under Thai immigration law, only spouses whose marriage has been 'legally registered' are considered. Without a registered marriage, you cannot use the dependent visa route and will need another visa type instead, such as a tourist visa.

Yes, but you must provide an official certificate of adoption registration from a government authority, and the document must be properly legalised (Legalization) to confirm the legal parent-child relationship.

In practice, for general business visas the immigration office usually only allows the spouse and children. The exception is companies promoted by the Board of Investment (BOI), where elderly parents may in some cases be allowed to apply as a special case. We recommend having ETHAIVISA assess your case first.

No. Under immigration law, a child holding a Dependent Visa must be no older than 20 full years. Once over 20, they must switch to another visa type, such as a student visa (Non-ED) if they are still studying in Thailand.

Both are possible. If you are abroad, you can apply for a Non-O visa in advance at a Royal Thai Embassy. Alternatively, if you enter Thailand on a tourist visa (with more than 15 days remaining on it), you can also apply for a 'change of visa type' to Non-O in Thailand.

You must apply at the immigration office covering the same area where the company of the main visa holder (the Non-B holder) is located. For example, if the company is in Bangkok and the main visa holder applies at Chaeng Watthana, the family must also apply at the Chaeng Watthana immigration office.

It is very convenient! If the company is promoted by the Board of Investment (BOI), the family can apply for and extend Dependent Visas online through the Single Window system, and collect the visa stamps at the Visa and Work Permit Service Center (One Bangkok) together with the main visa holder.

The immigration fee is 1,900 THB per person per application, the same for all nationalities (excluding the agency's document-handling service fee).

The Dependent Visa always expires on the same day as the main visa holder's Non-B visa. For example, if the husband's work visa has 8 months remaining, the wife's and children's Dependent Visas will also be approved for the same 8 months.

It is the 'proof of relationship', such as the marriage certificate or the child's birth certificate. If the document was issued by a foreign government, it must be translated into Thai or English and fully legalised (Legalization) by the embassy and the Thai Ministry of Foreign Affairs. Otherwise, the immigration office will definitely not accept the application.

No bank deposit is required. Many people confuse this with the Marriage Visa (Non-O Thai Wife). For dependants of business visa holders, the immigration office instead considers the 'income and tax payments' of the main visa holder (the Non-B holder), checking whether the salary meets the minimum threshold and taxes are paid correctly to support the family.

The company must issue an employment certificate for the main visa holder stating the wish to bring the family to live with them, together with a full set of company documents such as the company certificate, BOJ.5 (shareholder list), financial statements, PP.20 and past tax payment records (PND.1, PND.50), just as for a work visa extension.

It is absolutely essential. The immigration office will ask to see the main visa holder's original Work Permit book (or the profile page in the Digital Work Permit system) to verify that they are still actually employed and that the position details match the contract with the company.

The visa holder must sign. For a spouse, the dependent wife or husband signs personally. For a child who is a minor and cannot yet write, the father or mother signs on their behalf as guardian.

No. This Non-O Dependent Visa does not include the right to work. If a dependant wishes to work, a new employer must separately apply to change their visa type to Non-B and obtain a Work Permit properly.

It is an offence under both labour and immigration law. Both the foreign national and the employer face fines, the visa risks being revoked, and the foreign national may be deported (Deportation). So if you want to work, we recommend contacting ETHAIVISA to change your visa type correctly instead.

You can travel in and out as normal, but you 'must obtain a Re-entry Permit' at the immigration office or the airport every time before flying out. If you leave without a Re-entry Permit, the Dependent Visa will terminate immediately (unless you hold a Multiple Entry visa issued abroad).

They can study on it. Many schools accept children holding a Dependent Visa (Non-O Dependent) without requiring them to change to a student visa (Non-ED), which saves parents the hassle of submitting documents to several places.

Yes. Every foreign national staying in Thailand for more than 90 days, regardless of visa type (including Non-O dependants), is legally required to complete 90-Day Reporting. This can now be done online, or ETHAIVISA can handle it for you.

When the main visa holder's employment ends, the Non-B visa is cancelled, which automatically terminates the Non-O Dependent Visas of all family members on the same day. The family must leave the country together, or contact an agency immediately to find another visa type to change to.

No. Once the legal relationship ends, the right to hold the Dependent Visa ends immediately. The dependent foreign national must notify the immigration office and leave the country, or change visa type within the period prescribed by law.

The immigration office usually lets the family submit their extension applications at the same time. The family's visas will also receive the '21-day under consideration' stamp alongside, and approval is granted together on the day the immigration office schedules the final stamp in the passports.

It is usually because 'the dependant's passport has less validity remaining than the main visa holder's visa'. The immigration office will not stamp a visa beyond the expiry date of that passport. The solution is to obtain a new passport, then promptly transfer the visa to it and apply to extend the remaining period.

Because the immigration office very strictly checks the legal validity of relationship documents issued abroad, as well as the consistency of the employer company's accounting and tax documents. Even the smallest error can put the case on hold immediately. Choosing ETHAIVISA, which provides full-service document checking and certified translation, is the best way to save time and reduce risk for your family.
