Non-B Cancellation Thailand FAQ

Frequently Asked Questions: Work Visa Cancellation and Termination Notification (Non-B Cancellation)

By law, an annual Non-B visa ends immediately on the Last Working Day stated in the termination letter or resignation letter, not on the expiry date stamped in the passport. The company and the foreign national are therefore both obliged to report the cancellation properly.

Both parties will be at fault. The company may be fined for failing to report the end of employment within the required time, while the foreign national unknowingly becomes an overstayer (Overstay), which carries a fine of 500 THB per day (up to a maximum of 20,000 THB) and may affect future visa applications to Thailand.

For the Work Permit, the end of employment must be reported to the Department of Employment within 15 days from the date the foreign national ceased to be an employee. For the visa, the matter should be handled at the immigration office on the last working day so that the status is fully closed.

No, this is not possible, and it is a very important rule. Once the foreign national has left the country (whether or not they have a Re-entry Permit), the immigration system will not accept a retrospective visa cancellation. Instead, the old authorisation will be cleared or closed when that foreign national applies for a new visa extension.

It must be submitted at the same immigration office where the company applied for the person's annual visa extension. For example, if the application was made at Chaeng Wattana immigration, the cancellation must also be reported at Chaeng Wattana. For a BOI company, it must be processed through the BOI online system and the passport cleared at Chamchuri Square.

The correct procedure is to first report the end of employment to cancel the Work Permit with the Department of Employment. The endorsement or the receipt for that notification is then used as the main supporting document when applying to cancel the visa at the immigration office.

Yes, they must attend. The immigration officer needs the original passport in order to place a 'Cancellation of Permission to Stay' stamp (Cancellation Stamp) in it, and the foreign national must sign in front of the officer to acknowledge the visa end date.

It must be on company letterhead, addressed to the Superintendent of Immigration, and state the foreign national's full name, passport number, job position, last working day (Last working day) and the reason (resignation/dismissal). Most importantly, it must be signed by an authorised director and bear the company seal.

The standard visa cancellation stamp has no fee. However, if the foreign national applies for a 7-day extension to prepare to leave the country, the immigration fee for that is 1,900 THB.

Generally, the visa ends immediately on the day immigration stamps it (or on the date stated in the notice of termination). The foreign national must leave Thailand on that same day. If they do not leave in time, overstay (Overstay) begins immediately.

They can apply for a temporary extension of stay to prepare for departure, commonly known as the '7-day extension' (Extension for departure), at the immigration office on the same day the visa cancellation is reported. Immigration will stamp an additional 7 days so they can settle their affairs.

You will need the original passport, Form TM.7, a 2-inch photo, a copy of the flight ticket clearly showing the departure date (within those 7 days), and the 1,900 THB fee.

No. Immigration grants it only 'once', and it is strictly for the purpose of leaving Thailand. It cannot be extended again. Staying beyond this period will be treated as overstay (Overstay).

No. A Non-O dependent visa is tied to the main visa holder's rights. When the husband's or wife's Non-B is cancelled, the dependent visas of all family members end automatically on the same day, and their departure must be reported at immigration at the same time.

Yes, they must go together so that the immigration officer can stamp the visa cancellation in every family member's passport at the same time. If you wish to apply for the 7-day extension so that you can all fly out together, a separate TM.7 form must be submitted for each person.

Yes, the old authorisation must be cancelled first. However, so that the foreign national does not have to leave the country, a process known as 'Change of Employer in Thailand' (Change of Employer) can be used. The end date with the old company and the start date with the new company are scheduled to coincide, and everything can be completed at immigration in a single day, but the new company's documents must be 100% complete.

The foreign national can take the 'receipt of notification of end of employment' issued by the Department of Employment (which they can obtain by reporting their departure themselves or by submitting proof of resignation), and present it together with their passport at immigration to apply for the visa cancellation in person.

During the year, immigration will not check the Thai staff ratio right away. However, the ratio is strictly checked when the foreign national applies for their 'annual visa extension'. If the Thai staff numbers for the previous 3 months are insufficient at that time, the visa cannot be extended, which effectively means the visa must be allowed to lapse or be cancelled.

The law makes no exception for dismissal. The date the employment contract ends is the date the visa ends. The foreign national must go to immigration with the company right away to apply for the cancellation and the 7-day extension. Do not simply wait, as you will be charged with overstay (Overstay).

If a lawsuit has been filed and the case is not yet concluded, the foreign national can submit proof of the filing from the Labour Court or the Labour Protection and Welfare Office to immigration to request temporary permission to stay in Thailand while the case proceeds. Immigration will not allow the former company to cancel the visa until the proceedings have progressed.

Yes. When the end of employment is reported, the Department of Employment officer will retain the original Work Permit booklet. If it is a Digital Work Permit, the system will immediately revoke access and remove the person's name.

The risk of arrest and blacklisting is very high. Even though the stamp in the passport has not expired, the online databases of immigration and the Department of Employment will already show your status as 'employment ended'. If you try to fly back in using a Re-entry Permit and the immigration officer at the airport checkpoint finds the linked data during a random check, you will be refused entry and may be charged with giving false information.

A first 90-day visa obtained by changing the visa type in Thailand cannot be cancelled in the system. The correct way to clear it is for the foreign national simply to leave Thailand (without obtaining a Re-entry Permit). The 90-day permission will then end automatically.

You should keep it together with your passport. A short overstay (a few days) for which you have paid the fine to immigration will not result in a serious blacklisting. However, if you overstay for more than 90 days, you will be banned from entering the country (Ban) for between 1 and 10 years, as prescribed by law.

Because a cancellation requires coordination across several parties: the Department of Employment, the company's accounts and immigration. If the end-of-employment dates on the documents differ by even a single day, or the processing schedule is wrong, the foreign national may risk overstay or the company may be fined by government agencies. Letting ETHAIVISA manage the timeline and close the records professionally protects both the company and the foreign national, so everything is completed smoothly.
