Thai Child Visa (Non-Immigrant O) Requirements

Thai child visa requirements and document list (Non-Immigrant O - Dependent Child)

Requirements and documents for the visa to support a child of Thai nationality, the Thai Child Dependent Visa (Non-Immigrant O - Dependent Child), for new (first-time) applicants

This visa is issued to a foreign father or mother who needs to stay in Thailand to care for and support a child of Thai nationality. There are 2 main routes:

Key legal conditions and financial criteria

  1. Child's conditions: the child must be a Thai national and not older than 20 on the filing date.
  2. Legal relationship (very important for fathers):
    • Foreign mother: can apply immediately using the child's birth certificate naming the mother.
    • For a foreign father: if you are not registered as married to the child's mother, you must have either a "child legitimation registration certificate (KR.11)" or a "Thai court order recognising you as the legitimate father". If your name only appears on the birth certificate without any document confirming legitimacy, you cannot apply for this type of visa.
  3. Financial criteria (mandatory only for foreign fathers; foreign mothers are exempt from the deposit requirement in some cases, depending on the immigration office)
    • Deposit in a Thai bank account: at least 400,000 THB in the foreign father's sole name (for a first application in Thailand, the full amount must be shown on the filing date).

Route 1: Changing visa type inside Thailand (In-Country Conversion)

(For holders of a tourist visa (TR VISA) or a visa exemption stamp (P.30/P.60/P.90) who wish to change to a 90-day Thai Child Support Visa (Non-O) within Thailand, without having to leave the country)

Time requirement: your current visa must have at least 15 days remaining (we recommend applying as soon as your financial documents are ready).
📋 Required documents (Checklist):
  • Application form for change of visa type (TM.86 or TM.87)
  • Original passport with copies of all stamped pages
  • 1 photo, 2 inches in size (taken within 6 months)
  • Original birth certificate of the Thai child with a copy
  • Proof of legal relationship:
    • Child legitimation registration (KR.11) or a final order of the Thai Juvenile and Family Court (where the foreign father is not registered as married to the Thai mother)
    • Or the marriage certificate (KR.3) and marriage registration (KR.2), if the father is registered as married to the Thai mother
  • Documents of the child and the Thai spouse/mother: copy of the child's ID card (if any), copy of the child's house registration, and copy of the Thai mother's ID card
  • Financial evidence (foreign father):
    • Original bank letter confirming the deposit (Bank Guarantee) from a Thai bank, issued within 7 days, showing at least 400,000 THB
    • Original bank passbook with copies of the recent statement entries
  • De facto evidence (proof of support and living together):
    • Family photos: the foreign father/mother with the Thai child and Thai mother inside the home, in front of the house with the house number clearly visible, and activities together, 4-6 photos printed in colour on A4 paper
    • Residence map and residence notification receipt (TM.30) for the shared home

Route 2: Applying at a Royal Thai Embassy/Consulate abroad (Before Arrival)

(For a foreign father or mother living abroad who wants to obtain the Thai child visa in advance through the e-Visa system before travelling to Thailand, for an initial 90-day stay)

📋 Documents to upload to the Thailand e-Visa system (Checklist):
  • Passport valid for at least 6 more months
  • Digital photo, facing forward, light background (taken within 6 months)
  • Birth certificate of the Thai child (if issued abroad, it must be translated and legalized by that country's Ministry of Foreign Affairs and the Thai embassy)
  • Proof of legitimate fatherhood/motherhood (KR.11, marriage certificate or court order)
  • Copy of the child's ID card and house registration (and those of the Thai mother)
  • Bank statement for the last 3 months clearly showing the applicant's name and a balance in local currency equivalent to at least 400,000 THB, as required by the Thai embassy in that country
  • Flight reservation confirmation into Thailand

💡 Cautions and advice from ETHAIVISA

Father and child must appear in person: on the day you apply to change visa type in Thailand, the foreign father/mother, the Thai child and the Thai mother (if any) must all appear together at the Immigration Office to give statements to the officer.
Consideration period: as with the marriage visa, the Thai child visa has a consideration period of about 30 days, during which immigration officers may visit your home to verify that the foreign parent genuinely lives with and supports the Thai child, and is not making a false claim.
Foreign Parents of a Thai Child

In-depth conditions and care for foreign fathers and mothers

Immigration rules have specific assessment criteria, and our team has the expertise to help you correctly:

Foreign father (Father of a Thai Child)

The law requires the father to hold legal proof of paternity (e.g. marriage registration with the mother, child legitimation registration at the district office, or a court order), plus financial evidence of at least 400,000 THB in a Thai bank account or income of at least 40,000 THB per month.

Foreign mother (Mother of a Thai Child)

By law a foreign mother has full rights over the child as soon as she is named on the birth certificate, and is exempt from the income or bank deposit requirement in some cases (but supporting documents and residence evidence must still meet immigration criteria).

Child's age requirement

The Thai child must be no older than 20 and still under the applicant's care and support.

Thai Child Visa FAQ

FAQ: Frequently asked questions about applying for a Thai child dependent visa (first-time/new applicants)

It is a visa for a foreign father or mother who has a child of Thai nationality (under 20 years old) and needs to reside in Thailand to support, raise and legally protect the child.

Not yet. For a foreign father, being named on the birth certificate is not enough. You must prove "legal paternity" either by registering your marriage to the Thai mother, holding a child legitimation registration certificate (KR.11), or holding a Thai court order.

The foreign father and the Thai mother must bring the child and submit the application together at a district office in Thailand, so that the officer can issue the KR.11 certificate confirming the biological and legal relationship.

If the KR.11 cannot be registered at the district office (because the mother does not consent or cannot be contacted), the foreign father must file a petition with the Juvenile and Family Court in Thailand for a judgment declaring him the legal father. The court order can then be used to apply for the visa.

No. A foreign mother is already protected by her natural rights of motherhood. You can apply straight away using your child's birth certificate showing the mother's name, together with the hospital documents.

A foreign father must show a deposit of no less than 400,000 THB in a Thai bank account in his sole name only, or an income of no less than 40,000 THB/month. (Foreign mothers may be exempt from this financial requirement at some immigration offices.)

For a new application or a change of visa type to the initial 90-day Non-O in Thailand, the full 400,000 THB must be shown on the date of application. (There is not yet a requirement for the money to have been held for the previous 2 months; this 2-month rule applies when you apply for your annual extension in the next round.)

Absolutely not. The bank account used to show the 400,000 THB balance must be a sole account in the name of the foreign applicant only.

No. The financial requirement for the Thai Child Support Visa is assessed per applicant (father or mother) per application file, so no matter how many children you have, the basic deposit requirement remains 400,000 THB.

This is one of our core services. Our senior consultants are ready to provide legal advice, plan the structure and arrange a safe financial solution that complies with immigration regulations, so that your first application is approved smoothly.

Yes. You submit form TM.86 or TM.87 at the Immigration Bureau to change to a 90-day Non-O. Your current visa must have at least 15 days of validity remaining.

Yes, everyone must attend in person. The foreign father/mother, the Thai child and the Thai mother (if applicable) must all appear and be photographed in front of the immigration officer to confirm the genuine family relationship.

All family support visas have an "Under Consideration" period of about 30 days. To prevent false claims or forged documents, officers send the case to a screening board before endorsing the final approval.

Random inspections are very common. Local immigration officers may visit your home address to see whether the foreign father really lives with and raises the child. They may take photos, question neighbours or ask to see the child's belongings as supporting evidence.

Use colour photos printed on A4 paper, including: the father with the child in front of the house with the house number clearly visible, photos together in the living room and bedroom, and photos of childcare activities – 4-6 photos in total.

Yes. You apply through the Ministry of Foreign Affairs' Thailand e-Visa online system, selecting the Royal Thai Embassy in the country where you reside.

You will receive an initial stay of 90 days from the date you pass through the Thai immigration checkpoint (landing). Once in Thailand, you can extend it on an annual basis afterwards.

For a Royal Thai Embassy, documents in Thai or English can be uploaded as they are, without translation. However, if the birth certificate was issued by a foreign government, it must be translated into Thai or English and legalized first.

No, it is exempt. The Non-O child support visa does not carry a condition requiring health insurance with 3 million THB coverage, unlike some types of retirement visa.

No. By law, once a child reaches the full age of 20, they are considered to have attained legal majority, and the right to a "child support" visa ends immediately. The foreign father must switch to another type of visa instead (e.g. a Retirement Visa, if he meets the age requirement).

Under specific procedures, Indian nationals cannot submit their case through fast-track channels or agents. They must attend in person and queue as usual at the Lak Si immigration office only (separate from the Chaeng Watthana office). However, we can screen your KR.11 certificate and prepare your documents 100% correctly in advance.

Absolutely essential. The owner of your current residence must file the TM.30 notification for the foreigner within 24 hours of arrival. Without a TM.30 receipt, the Immigration Bureau will not consider the visa application file at all.

Yes. If the foreign father or mother wishes to work in Thailand, this Non-O visa can be used as the basis for applying for a Work Permit with the Department of Employment, fully in line with labour law.

Yes. Even though the relationship with your former wife has ended, your bond as the "legal father" of your Thai child remains 100% intact, as long as the child is under 20 and you continue to support the child in line with the requirements.

Because cases involving foreign fathers raise complex legal-paternity issues (KR.11/court orders), and the Immigration Bureau checks the genuine relationship very strictly. We take care of everything, from preparing your legal documents and checking your bank account timeline to setting up your family photos, with a senior consultant supporting you on site at the immigration office – so that your first step towards staying in Thailand to care for your child is as smooth and safe as possible.
